A decision from the U.S. Court of Appeals for the Fifth Circuit has reinstated the enforcement of the Corporate Transparency Act (“CTA”).  The Financial Crimes Enforcement Network (FinCEN) can now enforce the CTA and its BOI reporting requirements.  

The National Federation of Independent Business has indicated it is working to appeal this decision; however, enforcement stands. The Department of the Treasury has acknowledged additional time may be needed given the preliminary injunction and has pushed the filing deadline to January 13th, amongst other extensions as listed on FinCEN’s website.
